Project Description

When properly designed and implemented, public-private partnerships (PPP) may provide an invaluable source of additional private sector funding, capacity and resources to country’s infrastructure needs. These help overcome the inevitable restrictions of public resources for infrastructure construction, maintenance and provision of quality services. For this reason, PPP structures have become one of the most common instruments for developing infrastructure using the private sector resources and expertise. The availability of efficient and transparent policy, legal/regulatory and institutional frameworks encouraging private sector participation are vital for effective implementation of infrastructure projects through PPP structures.

Uzbekistan’s regime for PPP projects requires a substantial upgrade to comply with internationally recognised standards and best practice, and the Government of Uzbekistan has asked EBRD to provide technical assistance to support the design and development of an investor-friendly PPP regime in the country.

The objective of this project is to assist the Government (as represented by the Ministry of Economy and the Ministry of Justice) in building modern policy, legal and institutional frameworks for PPP projects in Uzbekistan. Technical assistance will be provided in several phases.

Phase 1 – Workshop on international standards and best practice for PPP frameworks

The objective of the workshop is to promote PPP international standards and best practice in Uzbekistan and lay the foundations for developing a modern PPP framework. The event will bring together public officials and local stakeholders, international and regional experts, legal practitioners and bankers, and private operators who will discuss the current state of play in Uzbekistan and ways of building an investor friendly PPP framework in the country based international standards and best practice in the region.

Phase 2 – Support with the Development of the PPP Policy and Legal Framework – will include:

a) legal gap analysis;
b) design and drafting of the PPP policy paper;
c) design and drafting of the PPP law and amendments to primary legislation necessary in the context of the new PPP Law; and
d) support to the Government with the legislative approval process.

Based on the outcomes of Phase 1 and Phase 2, further phases of the project may follow. The extent of EBRD’s potential engagement in such additional activities will depend on the Government’s commitment to the project implementation.

Independent Project Accountability Mechanism (IPAM)

If efforts to address environmental, social or public disclosure concerns with the Client or the Bank are unsuccessful (e.g. through the Client’s Project-level grievance mechanism or through direct engagement with Bank management), individuals and organisations may seek to address their concerns through the EBRD’s Independent Project Accountability Mechanism (IPAM).

IPAM independently reviews Project issues that are believed to have caused (or to be likely to cause) harm. The purpose of the Mechanism is: to support dialogue between Project stakeholders to resolve environmental, social and public disclosure issues; to determine whether the Bank has complied with its Environmental and Social Policy or Project-specific provisions of its Access to Information Policy; and where applicable, to address any existing non-compliance with these policies, while preventing future non-compliance by the Bank.
