Project Description

The European Bank for Reconstruction and Development (“EBRD” or “the Bank”) places special emphasis on institutional capacity building in its countries of operations. Sound public procurement is key to the Bank’s mandate under the Agreement Establishing the EBRD. Public procurement occupies a central place within the objective of fostering efficient use of public funds and contributes to corporate governance and capacity building. The Bank encourages international good practice in procurement, transparency in government procurement and enhanced competition, to enable efficient investment and thereby provide opportunities for successful transition.

The EBRD signed Memoranda of Understanding (MoUs) with the corresponding Governments of Serbia (“GoS”) and Bosnia & Herzegovina (“GoMBH”) to promote the development of the public procurement sector in their respective countries and in particular to:
i. develop and strengthen further cooperation in the sphere of public procurement policy, regulation of utilities and natural monopolies and monitoring of public procurement, as well as, PPP procurement framework;
ii. exchange information on a regular basis as appropriate, concerning technical assistance and public investment projects;
iii. render consultations with regard to the matters of mutual interest, wherever deemed necessary and upon initiative of either party;
iv. adopt forms of interaction in the field of public procurement policy and regulation, including (a) rendering methodological assistance, exchange of expert surveys and consultants’ reports, (b) exchange of experience in the field of conducting reviews, concerning the infringement of competition legislation, and (c) providing mutual and joint training, including training of trainers for the public procurement specialists with the purpose to exchange experience from the countries and the EBRD; and
v. seek to find ways to develop and provide structured and comprehensive Capacity Building in Procurement Programmes for public entities and EBRD Clients in the countries.

The proposed TC Project aims at supporting the work of Serbian and Bosnian institutions in assessing and adopting Action Plans in pursuit of the objectives set out in the MoUs. The beneficiaries of the first two TC assignments will be Serbia’s Republic Commission for Protection of Rights in Public Procurement Procedures of Serbia (“RCPRPPP”) and the Ministry of Public Administration and Local Self-Government in Serbia (MPALSG) (together, the “Beneficiaries”). The other beneficiary for BiH will be the Public Procurement Review Body of Bosnia and Herzegovina.

This TC Project has been design in line with the strategic fit for the Western Balkan strategies and the LTT strategy and in accordance with the MoU signed between the EBRD and the Governments of Serbia and BiH.

Project Objectives

Memoranda of Understanding between EBRD and Western Balkan Countries (Serbia and BiH) are implemented (the capacity of selected Institutions and Public Procurement Agencies to manage procurement is enhanced)

TC Recipient Information

The recipients are: Serbia’s Republic Commission for Protection of Rights in Public Procurement Procedures of Serbia, the Ministry of Public Administration and Local Self-Government in Serbia, the Public Procurement Review Body of Bosnia and Herzegovina.

Funding Summary

The assignments under the project are expected to be funded through EBRD-managed DFID/FCO Good Governance Fund.

Independent Project Accountability Mechanism (IPAM)

If efforts to address environmental, social or public disclosure concerns with the Client or the Bank are unsuccessful (e.g. through the Client’s Project-level grievance mechanism or through direct engagement with Bank management), individuals and organisations may seek to address their concerns through the EBRD’s Independent Project Accountability Mechanism (IPAM).

IPAM independently reviews Project issues that are believed to have caused (or to be likely to cause) harm. The purpose of the Mechanism is: to support dialogue between Project stakeholders to resolve environmental, social and public disclosure issues; to determine whether the Bank has complied with its Environmental and Social Policy or Project-specific provisions of its Access to Information Policy; and where applicable, to address any existing non-compliance with these policies, while preventing future non-compliance by the Bank.
