Project Description

Ukraine’s insolvency framework is undergoing a major transformation. A significant milestone was reached on 1 January 2025, when Law No. 3985 IX entered into force, harmonising national insolvency legislation with EU Directive 2019/1023 on preventive restructuring frameworks, discharge of debt, disqualifications, and measures to increase the efficiency of restructuring and insolvency procedures.

Project Description

On 5 February 2026, the Government approved a draft law introducing simplified bankruptcy procedures for micro and small businesses. The draft (Registration No. 15004 dated 06/02/2026) was submitted to the Verkhovna Rada on 6 February 2026.

This Project aims to support the Ministry of Justice's continued alignment of Ukraine’s legal and institutional insolvency framework with EU standards and best practices, which is part of Ukraine's “Roadmap on the Rule of Law” adopted in May 2025, a key strategic document guiding reforms in the justice sector, commercial law, and alignment with the EU acquis.

Strengthening the restructuring and insolvency system is essential not only for meeting EU accession requirements but also for enabling economic recovery in the post conflict period. Specifically, this Project will assess the role of both laws and institutions in closer EU alignment and will support the amendment of Ukraine's legal framework to align with the new EU insolvency harmonisation directive expected in 2026.

Independent Project Accountability Mechanism (IPAM)

If efforts to address environmental, social or public disclosure concerns with the Client or the Bank are unsuccessful (e.g. through the Client’s Project-level grievance mechanism or through direct engagement with Bank management), individuals and organisations may seek to address their concerns through the EBRD’s Independent Project Accountability Mechanism (IPAM).

IPAM independently reviews Project issues that are believed to have caused (or to be likely to cause) harm. The purpose of the Mechanism is: to support dialogue between Project stakeholders to resolve environmental, social and public disclosure issues; to determine whether the Bank has complied with its Environmental and Social Policy 2024 or Project-specific provisions of its Access to Information Policy; and where applicable, to address any existing non-compliance with these policies, while preventing future non-compliance by the Bank.
