Project Description

The European Bank for Reconstruction and Development (the “EBRD” or the “Bank”) is committed to building deep and liquid energy markets in its Countries of Operations, including through the strengthening of independent regulation, the implementation of market-supporting regulatory frameworks, and the entrenchment of market-based behaviour.

A programme of gradual yet deep electricity market reform was initiated in Egypt with Law 87/2015; targeting transition from a traditional, vertically integrated, regulated state monopoly model to that of a fully competitive market. The Law envisages the gradual liberalisation of the electricity sector with extensive private sector participation, including through the establishment of a deregulated segment in which eligible private consumers will be able to choose directly their own retail suppliers. At the same time, Egypt possesses significant renewable potential and is committed to capturing the full value of this indigenous resource base, to the benefit of the Egyptian energy system and consumers.

In March 2024, the Board of EgyptERA approved the regulatory rules for bilateral contracting (the “P2P” scheme), detailing eligibility for the scheme, the roles and responsibilities of different stakeholders and operational and financial arrangements for balancing excesses / shortfalls in generation or consumption, in order to incentivise accurate forecasts and hence minimise the negative impact on the wider system.

A significant pipeline of potential producers and consumers have expressed interest in the P2P scheme and so, in order to test the rules and allow relevant stakeholders an opportunity to adjust, EgyptERA launched in June 2024 a pilot in which five 100MW RES projects will be selected to be developed under the scheme. A Circular, published on the EgyptERA website, sets out the intended scoring mechanism..

The EBRD will engage a consultant that will cover all relevant aspects of the work required to successfully deliver the first projects within the pilot phase of the P2P framework and expected to include, but not be limited to, supporting:

Assessing eligibility of applicants by answering queries, conducting research to verify financial standing, previous experience, and confirming they meet the criteria for producer or consumer status.
Implementing the selection process for P2P pilot phase projects, involving collation and scoring of proposals submitted via a form.
Negotiating with selected projects, discussing and resolving any issues.
Developing and interpreting P2P rules, drawing on best practices and industry views to address implementation challenges, possibly through clarification memos or amendments.
Advising on financial performance guarantees, such as the size of completion bonds, and assessing project progress to determine if bonds should be called.
Supporting EETC with their P2P responsibilities, advising on project scheduling and providing capacity building.

Independent Project Accountability Mechanism (IPAM)

If efforts to address environmental, social or public disclosure concerns with the Client or the Bank are unsuccessful (e.g. through the Client’s Project-level grievance mechanism or through direct engagement with Bank management), individuals and organisations may seek to address their concerns through the EBRD’s Independent Project Accountability Mechanism (IPAM).

IPAM independently reviews Project issues that are believed to have caused (or to be likely to cause) harm. The purpose of the Mechanism is: to support dialogue between Project stakeholders to resolve environmental, social and public disclosure issues; to determine whether the Bank has complied with its Environmental and Social Policy or Project-specific provisions of its Access to Information Policy; and where applicable, to address any existing non-compliance with these policies, while preventing future non-compliance by the Bank.
