Project Description

Background: The Government of Kazakhstan has been committed to a broad economic reform program. EBRD plays a great role in facilitating and implementing the reforms by providing technical assistance. The Government of Kazakhstan addressed EBRD with the request to provide technical assistance on reforming the tariff policy and regulatory framework for natural monopolies and dominants in infrastructure sector. The Bank approved Tariff TC with the objectives to provide assistance to the authorities of Kazakhstan in reforming the existing system of tariff regulation for natural monopolies and dominants in infrastructure sectors, adopting a modern and transparent framework for regulation, as well as strengthening the institutional powers and means to implement and administer such framework. As of October 2015, the Bank has completed Phase 1 of Tariff TC by providing the Government with recommendations on improving the tariff policy and regulatory framework. The Government has agreed with these recommendations and requested actual implementation of these recommendations on the basis of pilot projects, which will constitute Phase 2 of the project.

Strategic fit: (i) Phase 2 of theTariff TC Project addresses the key transition impact gaps across regulated sectors, as identified in the previous ATCs and country strategy for Kazakhstan; (ii) changing tariff methodology and level have also been identified by the Government of Kazakhstan as one of the key structural reforms required for the economy.

Phase 2 fits within the following strategies of the EBRD: Country Strategy for Kazakhstan (BDS/KA/13-1), MEI Strategy (BDS11-126), Transport Sector Strategy (BDS13-205), Energy strategy (BDS13-291), the Mining Operations Policy (BDS12-219) and other sector strategies, which describe the significant transition challenges in the sectors in the following areas: (i) improvements in regulation; (ii) further tariff increases and collection rates; (iii) further increase in meter-based billing in smaller municipalities, and (iv) increase in private sector participation and introduction of PPP structures.

During the Phase 2, the main objective is to support the Government of Kazakhstan in actual implementation of recommendations made during the Phase 1 on a pilot basis, which will lead to building and adopting a modernised legal, institutional and methodological framework for economic regulation of infrastructure in Kazakhstan that will be conducive to economic efficiency and incentive regulation and likely to attract and sustain private investment throughout the Kazakh economy.

Independent Project Accountability Mechanism (IPAM)

If efforts to address environmental, social or public disclosure concerns with the Client or the Bank are unsuccessful (e.g. through the Client’s Project-level grievance mechanism or through direct engagement with Bank management), individuals and organisations may seek to address their concerns through the EBRD’s Independent Project Accountability Mechanism (IPAM).

IPAM independently reviews Project issues that are believed to have caused (or to be likely to cause) harm. The purpose of the Mechanism is: to support dialogue between Project stakeholders to resolve environmental, social and public disclosure issues; to determine whether the Bank has complied with its Environmental and Social Policy or Project-specific provisions of its Access to Information Policy; and where applicable, to address any existing non-compliance with these policies, while preventing future non-compliance by the Bank.
