Project Description

Several EBRD countries of operations reported challenges with digital transformation and in particular introducing electronic procurement systems. One of the biggest challenges public administration faces is the ability to successfully address complex challenges and translate new government policies into a clear and contemporary legal framework and appropriate digital implementation tools. This is particularly true for Open Government agenda in government commerce which require structural change, new business models as well as sophisticated electronic tools integrated with national e-government and e-commerce frameworks. Difficulties with introducing electronic public procurement procedures and electronic sales platforms are related to complex policy decisions regarding: (a) level of decentralisation of public spending, (b) designing digital public procurement and public sales cycles to suit local market requirements and availability of e-government services (c) establishing central public sales and public purchasing units for strategic sectors with appropriate set of digital Business2Government tools. It is difficult to disrupt horizontal government processes and core systems such as public procurement and public sales while continuing to provide essential public services. Also, public administration resistance to change and institutional interests and control of resources needs to be actively managed to offer incentives to embrace and promote change, bottom-up or top-down, as appropriate for local governance culture.

With modern e-government and digital government commerce tools structural reforms require less regulation and more user-focused implementation tools, while excessive use of regulations as a way to manage complexity is frequently preferred way of public governance to avoid change that brings accountable and value-based decision-making.

The Government of Armenia is implementing a digital government project and requested support in respect to modernisation of public procurement and public sales systems. The project is aiming to contribute to implementation of an integrated, interoperable and inclusive digital public procurement and public sales scheme for public sector in Armenia.

The overall objective is to facilitate implementation of modern electronic public procurement schemes promoting digital public procurement cycle within national e-government and e-commerce solutions to increase the speed and economy of procurement processes while ensuring a full transparency of public procurement decisions. Furthermore, the project will develop a transparent, fast and effective electronic trade system based on Open Data, Open Source and Open Contracting Data Standard and pilot it on the sale of (i) assets of the banks in liquidation (ii) mortgaged assets by commercial banks to prevent abuse, ensure equal access to sales data, public control and increasing the number of potential buyers. The electronic trade systems is intended to be piloted on a voluntary basis by the authorised until the amendments to their laws will make mandatory the use of the system.

The Project will deliver regulatory, legal and business advice on public procurement policy and electronic public procurement by providing data methodologies, consultancy services, and development work which all together are intended to develop, test, train and launch a comprehensive Open Government Open Data OCDS-based Open Source solution to deliver interoperable and inclusive digital public procurement cycle forming an integral part of digital government in Armenia. The solution will be developed in compliance with the Directive 2014/24/EU and shall support obligatory procurement methods as well as online-only public procurement purchasing techniques – electronic catalogues, electronic reverse auction, framework agreements and dynamic purchasing system. The ‘end-to-end’ electronic public procurement shall include electronic signing of public contracts, invoicing and payment as well as enable implementation of horizontal public procurement policies on environmental, social and economic growth, as requested by relevant sector ministries in Armenia.

Independent Project Accountability Mechanism (IPAM)

If efforts to address environmental, social or public disclosure concerns with the Client or the Bank are unsuccessful (e.g. through the Client’s Project-level grievance mechanism or through direct engagement with Bank management), individuals and organisations may seek to address their concerns through the EBRD’s Independent Project Accountability Mechanism (IPAM).

IPAM independently reviews Project issues that are believed to have caused (or to be likely to cause) harm. The purpose of the Mechanism is: to support dialogue between Project stakeholders to resolve environmental, social and public disclosure issues; to determine whether the Bank has complied with its Environmental and Social Policy or Project-specific provisions of its Access to Information Policy; and where applicable, to address any existing non-compliance with these policies, while preventing future non-compliance by the Bank.
