Standard Procurement Documents and Guidance Notes

Following the latest the revision of the Procurement Policies and Rules in May 2022, the Bank has developed a new suite of Standard Procurement Documents (SPD). These new documents reflect the changes in the Procurement Policies and Rules and incorporate the updated integrity and environmental, social, health and safety requirements of the Bank, as well as take into account commentary from the market and clients to the current and preceding versions of the documents.

A new modular approach was followed in developing the new SPD, whilst the current structure (sections) remained unchanged. Many parts of the documents are now cross-harmonised and can be used in all procedures defined in the Procurement Policies and Rules regardless of the contract type. A large library of forms is created to streamline the preparation of procurement documents by Bank’s Clients, as well as the preparation of applications and proposals by prospective participants.

The new SPD are designed to enable easy use of the EBRD Client E-Procurement Portal (ECEPP) as a default option, however provisions are made if alternative systems or formats would be needed.

New General Conditions of Contract (GCC) for Goods and Related Services and for Consultancy Services have been developed. These GCC do not contain provisions specific to the Bank’s policies or procedures, thus, may be used outside of Bank’s projects. At the same time the new SPD provide for use of a broader spectrum of internationally recognised contract terms and conditions, which may be suitable for specific circumstances.

The new suite of SPD has become a default option since 1 July 2023.

For procurement processes initiated before 1 July 2023 the Clients may use the previous version of the SPD subject to aligning with the new provisions of the Bank’s Procurement Policy and Rules (Rev. May 2022). With Bank’s prior written consent, similar arrangements may be followed for procurement processes in projects approaching completion, where previous version of the SPD has already been used extensively for similar contracts.

Relevant guidance in support of new SPD reflecting the Procurement Policies and Rules and other documents will be published on the Bank’s web-site in due course.
