Terms and Conditions
Born in '89 Essay Contest
1. The organiser of this competition is the European Bank for Reconstruction and Development, an international organisation with its headquarters located at One Exchange Square, London, EC2A 2JN, the United Kingdom (the "EBRD").
2. Essays should be clearly headed with the entrant’s full name, address and phone number including international dialling code. Entries that do not contain this information in a clear and legible form may be disqualified.
3. The entrant whose essay is selected as the overall winner will win a one-week internship at the Financial Times newspaper in London. The duration, dates and nature of this internship are to be confirmed and all details of this internship will be at the discretion of the EBRD. The EBRD may, at its sole discretion, substitute the prize for a prize of a similar nature and/or comparable value. There is no cash alternative to the prize.
4. Details of how to enter form part of the Terms and Conditions. It is a condition of entry that all rules are accepted as final and that the competitor agrees to abide by these Terms and Conditions. Only entries received in accordance with all Terms and Conditions will be acceptable. In the event of any dispute regarding the competition processes, judgement and prize, the decision of the EBRD shall be final and no correspondence shall be entered into.
5. The EBRD will cover reasonable and documented travel and accommodation costs for the shortlisted finalists attending the prize award ceremony in London in spring 2010, as well as travel and accommodation costs for the overall winner during their internship at the Financial Times. No salary or other form of remuneration will be paid to the winner during the internship. Entrants shall be responsible for obtaining and covering the costs for appropriate travel and medical insurance, entry visa (if required) for the travel to London and the duration of their stay in the United Kingdom. The EBRD shall (to the extent permitted by the applicable law) not be liable for death, sickness, injury, damage or loss, of any kind or nature, incurred as a result of, or in connection with any entrant’s travel to London and during the entrant’s stay in the United Kingdom. Furthermore, to the extent permitted by the applicable law, the EBRD shall not be liable to an entrant under or in connection with these Terms and Conditions for any loss or damage whether direct, indirect, financial, economic, or consequential, whether or not caused by the negligent act or omission of the EBRD.
6. The competition is open to anyone who was born in the year 1989 and is a citizen of one of the EBRD’s countries of operations. These are Albania, Armenia, Azerbaijan, Belarus, Bosnia & Herzegovina, Bulgaria, Croatia, Estonia, FYR Macedonia, Georgia, Hungary, Kazakhstan, Kyrgyz Republic, Latvia, Lithuania, Moldova, Mongolia, Montenegro, Poland, Romania, Russia, Serbia, Slovak Republic, Slovenia, Tajikistan, Turkey, Turkmenistan, Ukraine, Uzbekistan. The EBRD reserves the right, at its discretion and without providing reasons for its decision, to disqualify any entrant if it has cause to believe that the entrant does not meet the prerequisite entry criteria.
7. Staff members and officials of the EBRD, the Financial Times or the Unicredit group and their families (including parents, grandparents, siblings, spouses and children) may not enter the competition.
8. Only one entry per person will be accepted. Entrants may not re-submit an altered version of an essay they have already submitted.
9. Entries may be submitted via an e-mail form on the EBRD website or by posting to Born in '89, EBRD Communications Department, One Exchange Square, London, EC2A 2JN, the United Kingdom. Proof of posting or e-mailing essays cannot constitute proof of delivery. The EBRD cannot accept responsibility for any submitted essays which do not reach the EBRD or are damaged or delayed, whether they were sent in printed or electronic form. The closing date for the competition is 31 December 2009 and entries received after that date will not be considered. Winners will be notified on or before 31 May 2010.
10. By entering an essay into the competition entrants hereby assign, with full title guarantee all intellectual property rights (including, without limitation, copyrights) to that essay to the EBRD on an exclusive basis and without any specific territorial restriction and acknowledge that the EBRD will own all the intellectual property rights to the essay and shall have the right, without limitation, to publish, reproduce, record and/or distribute, in whole or in part, in any language and format (including, but not limited to, audio-visual, print, audio-recording, electronic, Internet, CD-ROM, computer-readable, etc.) and in all media, the essay, any oral or written material, and/or presentation by the entrant of the essay, or made in connection with the entrants participation in the competition. The assignment will take effect on the day when EBRD receives the respective essay.
The intellectual property rights granted to the EBRD shall be for a term equal to the life (duration) of the respective intellectual property right under the applicable national and/or international laws, under which the intellectual property right is registered and/or protected and shall extend to any re-prints and re-publications.
Each entrant warrants that he/she has not and will not assign intellectual property rights and/or to grant license(s) or other similar transfer of rights, with respect to the intellectual property rights in relation to the essay, to any person or entity, with entering the essay in this competition.
The entrant's essay will be credited to them and the EBRD will identify the entrant as an author, but the entrant will not receive remuneration of any form or kind (including royalties, license fees, etc.) for their participation in the competition and/or the publication, reproduction, recording and/or distribution of their essay and/or any oral or written material, and/or presentation by the entrant of the essay, or made in connection with the entrants participation in the competition.
The EBRD reserves the right to edit essays before publication or to reproduce an excerpt only. Any publication, reproduction, recording of the essay and/or any oral or written material, and/or presentation by the entrant of the essay, or made in connection with the entrants participation in the competition, shall include a disclaimer that the essay reflects the views, opinions, beliefs of the author and do not necessarily reflect, and should not be construed as reflecting, the views and/or opinion of the EBRD and that the EBRD does not make any representation, warranty or undertaking, express or implied, as to, or assume any responsibility for:- (i) the completeness or accuracy of the information contained in the essays; (ii) the reasonableness of the assumptions or the information on which it was based; or (iii) the suitability of the information for any purpose.
11. By entering an essay into the competition, entrants hereby confirm that the content of that essay is entirely their own original work and is not in any part a reproduction of the work of another individual and warrant that the essay, which they have submitted, its form and/or content, does not libel anyone, invade anyone's privacy, infringe anyone's intellectual property rights (including copyright), or otherwise violate any statutory or common law right of anyone. Entrants agree to indemnify, hold and save the harmless, and defend, at its own expense the EBRD, its Directors, Alternates, officers, employees and/or experts performing missions for the EBRD from and against all suits, claims, demands, losses, damages, and liability of any nature or kind, including their costs and expenses, which they may sustain in consequence of or arising out of, or in connection with any use(s) or publication(s) which the EBRD makes of the essay, or any part thereof, and/or breach of the foregoing confirmation an/or warranty.
12. The winner and / or finalists may be asked to participate in publicity surrounding this competition. By submitting their essay, all entrants consent to their name, locations and photographs being published in print and online content, and/or any other media, in relation to their competition entries.
13. These Terms and Conditions will be governed by English law. Nothing in these Terms and Conditions shall be construed as a waiver, renunciation or other modification by EBRD of any immunities, privileges and exemptions of EBRD accorded under the Agreement Establishing the European Bank for Reconstruction for Development, international convention or any applicable law.
